1. Acceptance of Terms

By downloading, installing, or using Fluid IPTV (the "Application"), or by making a purchase on the website fluidiptv.com (the "Website"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application or the website.

The application and the website are operated by Pierre-yves Boulbin. Use is also subject to our Privacy Policy, which is incorporated into these terms by reference.

2. Description of Service

Fluid IPTV is an IPTV player application available on iOS, tvOS, and Samsung Tizen. The application allows users to play IPTV streams from their own sources.

Fluid IPTV does not provide, host, or distribute any content. The application is exclusively a media player.

The application offers a Premium version with advanced features, available through the purchase of an activation code on the website.

3. User Responsibilities

By using the application, you agree to:

  • Only use the application in compliance with applicable laws and regulations in your jurisdiction
  • Ensure you have the necessary rights to access any content you stream through the application
  • Not use the application for any illegal or unauthorized purpose
  • Not attempt to bypass security measures or restrictions of the application
  • Not reproduce, duplicate, copy, sell, or resell the application

4. Intellectual Property

The Fluid IPTV application, including its source code, design, logos, and all associated content, is the exclusive property of Pierre-yves Boulbin and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the application for personal, non-commercial purposes, in accordance with these terms.

5. Premium Purchases and Payments

Website Purchases

The purchase of the Premium version for Samsung Tizen is made on the website fluidiptv.com. The process is as follows:

  • You provide your Samsung TV's MAC address and your email address
  • You can apply a promotional code if you have one
  • Payment is processed securely via PayPal
  • A unique activation code is sent to you by email

Pricing

This is a one-time payment (non-recurring). The price is displayed on the purchase page before payment confirmation. Prices include applicable VAT.

Promotional Codes

Promotional codes offering discounts may be offered. They are subject to validity, expiry, and usage limits. Promotional codes are non-transferable and cannot be combined.

Activation Codes and Licenses

Each activation code is unique and bound to a single device (MAC address). The license grants lifetime access to Premium features on the registered device. Licenses are non-transferable to another device.

Possible license statuses:

  • Inactive — awaiting activation on the TV
  • Active — in use
  • Revoked — deactivated by admin for policy violation

App Store Purchases

On iOS and tvOS, certain features may be available through in-app purchases processed by Apple's App Store. These purchases are subject to Apple's terms and refund policy.

5bis. Supplier TV Partnership Program

Program Terms

The TV Partnership program allows registered suppliers to purchase TV Premium access at a preferential rate for redistribution to their clients. Each purchase generates a unique retrieval code that the end client enters on the TV application.

Pricing and Payment

The preferential rate is displayed on the TV access creation page in the supplier panel. Payment is processed via PayPal. This is a one-time payment per TV access (non-recurring). Promotional codes may apply.

Supplier Responsibilities

  • The supplier is responsible for the validity and legality of the IPTV credentials (M3U URL or Xtream Codes) they provide
  • The supplier agrees to inform their clients that they are using the Fluid IPTV application and to direct them to these terms
  • The supplier may not resell retrieval codes at a price exceeding the final rate including the supplier margin

Non-Refundable Activated Licenses

Once a retrieval code is used and the license activated on a TV device, no refund is available. The supplier can revoke access to the IPTV credentials from their panel, but the Premium license remains active on the device.

6. Right of Withdrawal and Refunds

In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and express acknowledgment of loss of the right of withdrawal.

Before completing your purchase, you must expressly consent to the immediate delivery of the digital content (activation code) and acknowledge that you thereby waive your 14-day right of withdrawal.

As a result, no refund is available once the activation code has been delivered. Exception: if the activation code is defective or cannot be activated due to a technical issue on our side, you may contact support for a resolution.

7. Content Disclaimer

Fluid IPTV is exclusively a media player. We do not provide, host, control, or distribute any content accessible through the application.

Users are solely responsible for the legality of the content they access. We disclaim any liability for content streamed by users through the application.

8. Prohibited Uses

You may not use the application to:

  • Access content in violation of copyright or any other applicable law
  • Attempt to reverse engineer, decompile, or disassemble the application
  • Interfere with or disrupt the operation of the application
  • Use the application in a way that damages, disables, or overloads our services

9. Limitation of Liability

To the fullest extent permitted by applicable law, Pierre-yves Boulbin shall in no event be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from:

  • Your use or inability to use the application
  • Any content obtained through the application
  • Any unauthorized access to your data
  • Any interruption or cessation of the service

10. Disclaimer of Warranties

The application is provided "as is" and "as available", without any warranty of any kind, express or implied. We do not guarantee that the application will be uninterrupted, secure, or error-free.

11. Termination

We reserve the right to suspend or terminate your access to the application, without notice or liability, for any reason, including in the event of a violation of these terms.

In the event of a license revocation, the activation code will be deactivated and access to Premium features will be terminated.

Upon termination, the provisions of these terms that, by their nature, should survive termination will remain in effect.

12. Governing Law

These terms are governed by and construed in accordance with French law. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the French courts.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will take effect upon posting in the application or on our website. Your continued use of the application after the posting of changes constitutes your acceptance of the new terms.
